Ogarda Transfer provides services on the basis of the following General Terms and Conditions, service descriptions and price lists. Deviating terms and conditions do not apply, even if Ogarda Transfer does not expressly object to them. Deviations from these conditions require the express written approval of Ogarda Transfer. A contract is only concluded if it is confirmed by Ogarda Transfer.

scope of performance

The scope of services shall be determined exclusively by the written order confirmation of Ogarda Transfer or, subsidiary, by the written offer of Ogarda Transfer. Information contained in brochures, service catalogues, price lists and similar information shall only be binding insofar as it is expressly referred to. The transport takes place according to the regulations of the StVO and the PbefG. Passengers must follow the instructions of Ogarda Transfer or the chauffeur. If guests act against the instructions, or if they represent a danger according to the Italian Road Traffic Regulations, or the safety of road traffic due to impairments of the chauffeur, Ogarda Transfer is entitled to exclude them from carriage. In this case, Ogarda Transfer will charge the full fare including the fixed price or kilometer price and all ancillary and special services.

Airport pick-up (airport transfer)

Ogarda Transfer must be informed immediately of any change in the agreed collection time, for whatever reason. Damages caused by a not immediate notification are at the expense of the customer. The chauffeur of Ogarda Transfer is available at the agreed pick-up time at the respective meeting point of the airport terminal, or at the previously agreed meeting point in writing, with a name plate or company logo (earlier or later provision must be specified when booking) and waits up to 60 minutes without separate charge. A telephone number where the passenger can reach his chauffeur is given in the confirmation letter. If no contact with the passenger or customer is established after the 60-minute waiting period, the chauffeur will return to Vienna without the passenger. The service of Ogarda Transfer shall then be deemed to have been rendered and the full fare shall be due for payment. Further waiting times requested by the customer will be calculated according to the valid price list.


The prices contain the legal value added tax in the respective legal height. The prices valid on the day of the booking confirmation apply. All-inclusive prices not listed in the price list can only be agreed in writing and are only valid for the agreed travel date and rental period. Any additional times and distances will be charged according to the valid price list. Additional costs due to delays shall be borne by the customer, unless the delays are due to the fault of Ogarda Transfer or the chauffeur. The fare includes the carriage of passengers with normal luggage; the carriage of bulky goods requires a separate agreement.

payment regulations

Ogarda Transfer reserves the right to charge a deposit of up to 50% of the total price prior to commencement of the journey or to request a blank charge slip of a valid credit card issued at Ogarda Transfer prior to acceptance of an order. The balance is due for payment within the periods indicated on the invoice. For the timeliness of the payment it depends on the receipt of the amount at the unconditional disposal of Ogarda Transfer. In the case of payment by cheque, the claim shall not be deemed to have been paid until it has been finally credited in full. Payments shall always be used to settle the oldest claim. If the customer is in default of payment, Ogarda Transfer - subject to the assertion of further damages caused by default - shall charge interest at a rate of 5 percentage points above the base rate. For the second and each further reminder € 10, reminder fee will be charged. The customer reserves the right to prove a lower damage.

Cancellations and Withdrawals

Cancellations shall only become effective if they are made in writing or if they are confirmed in writing by Ogarda Transfer in the event of a verbal declaration. For the timeliness of written cancellations, it depends on the arrival at Ogarda Transfer. Cancellations up to and including 24 hours prior to the contractually agreed commencement of the journey are free of charge. In the event of cancellation, Ogarda Transfer will charge a share of the basic fare as compensation. This portion amounts to:
* 50 % for cancellations up to 12 hours
* 80 % for cancellations up to 3 hours prior to the contractually agreed commencement of service performance
* 100 % for later cancellations and non-arrival.
Ogarda Transfer shall charge expenses irrespective of the timeliness of the cancellations, if these have already been incurred. The customer is expressly permitted to prove that no or a lower damage was incurred by Ogarda Transfer. Ogarda Transfer reserves the right to withdraw from the contract in whole or in part if the customer suspends payment, becomes insolvent or, due to external circumstances, it can be assumed that the services will be used improperly or if the customer violates the obligation incumbent on him under these contractual provisions.

Obligations and liability of the customer

The customer shall notify Ogarda Transfer immediately of any change in its name, (invoice) address, legal form and bank details. The customer is also obliged to provide the necessary information on passengers, time and place of performance. If the customer fails to notify us immediately, he shall be liable for damages that would have been avoided if he had notified us in good time. The customer undertakes not to misuse the services of Ogarda Transfer on behalf of the passengers, in particular to
* not to interfere with or hinder the provision of the service
* not to cause any damage
* not to violate criminal law regulations
* strictly observe the smoking ban in the vehicle
* not to refuse to pay the fare.
If a customer violates the aforementioned obligations, Ogarda Transfer is entitled to take all necessary measures to eliminate the abuse. In the event of culpable infringement, the customer shall be liable to Ogarda Transfer for damages.

Liability of Ogarda Transfer

Ogarda Transfer shall be liable to the customer for damages - irrespective of the legal basis - only in the event of intent or gross negligence as well as culpable breach of essential contractual obligations by Ogarda Transfer, its legal representatives or vicarious agents. Liability for injury to life, limb or health shall be governed by the statutory provisions. The liability of Ogarda Transfer for property damage is limited to € 1,000. 00 per passenger. The vehicles are subject to a liability breach in accordance with the applicable General Insurance Conditions. The customer must take care of any supplementary insurance himself. Ogarda Transfer is not liable for missed deadlines and their economic consequences, unless these were caused by Ogarda Transfer. This includes e. g. delays; delays caused by:
* Traffic jams, road closures
* Vehicle breakdowns or traffic accidents
* bad weather
Ogarda Transfer does not assume any liability towards the customer or passenger for damages resulting from incorrect transmission of data by the customer.

Applicable law and place of jurisdiction

All legal relationships between Ogarda Transfer and its customer shall be governed exclusively by Italian law. Place of jurisdiction and performance is Brescia.
partial ineffectiveness
Should one or more of the above conditions be invalid, the remaining conditions shall remain unaffected by the invalidity. The ineffective clauses shall be replaced by the statutory provisions.
